What is the No-Fault Law in Florida?
Florida’s no-fault insurance law requires nearly every driver in the state to carry a minimum of $10,000 in personal injury protection (PIP). It follows drivers in their personal vehicle, a borrowed car or even a rental car, and it covers them for medical bills and lost earnings regardless of fault when they’re in an accident. With an experienced and local Bradenton personal injury attorney by your side, you can ensure that you will receive as much compensation as possible for any injuries through your PIP. Here’s what the PIP pays:
- 80 percent of all medical bills.
- 60 percent of lost earnings.
- 100 percent of replacement services costs.
- $5,000 in death benefits.
Under Florida Statute 627.737, a person who was injured in a private motor vehicle accident that was caused by the negligence of somebody else cannot seek compensation for non-economic damages like pain and suffering unless that victim can overcome the state’s serious injury threshold. To do so, the victim must show that his or her injuries consist of at least one of the following conditions:
- Permanent injury or loss of a bodily function, other than scarring or disfigurement.
- Significant scarring or disfigurement, considered permanent.
- Death.
If the victim’s medical bills and lost earnings resulting from the crash are in excess of $10,000, he or she has also overcome the threshold limit.
A bill is presently pending in the Florida legislature to repeal the state’s no-fault insurance statute and be replaced with a fault-based system. The state’s no-fault statute is limited in scope as it’s only applicable to accident cases when a person’s medical bills and lost earnings are less than $10,000 and no permanent injury has been suffered.
